1. Service Description
PhotofitMe is an online service operated by Maggetti that allows users to upload photographs of their face and receive an AI-generated Photofit composite portrait in the style of the classic 1970s police facial identification system. The Service also offers a public gallery where users may display their composites, and a range of printed merchandise products featuring the composite portrait.
By accessing or using the Service, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 18 years of age to use the Service, or have the consent of a parent or guardian who accepts these Terms on your behalf. By using the Service, you confirm that you meet this requirement.
You must have the right to upload any photograph you submit to the Service. By uploading a photograph, you confirm that it is a photograph of yourself or that you have the explicit consent of the person depicted to use their likeness in this way.
3. User Content
You retain all copyright and ownership rights in any photographs you upload to the Service (“User Content”).
By uploading a photograph to the Service, you grant Maggetti a limited, non-exclusive, royalty-free licence to process the image solely for the purpose of generating your Photofit composite. This licence does not extend to any other use. Your original photograph is deleted immediately after composite generation unless you have separately opted to retain it.
If you choose to submit your composite to the public gallery, you grant Maggetti an additional non-exclusive, royalty-free licence to display your composite image publicly on the PhotofitMe website and associated marketing materials for as long as your gallery entry remains active. You may withdraw this licence at any time by removing your entry from the gallery.
4. Acceptable Use
You agree that you will not:
- Upload photographs of other people without their explicit consent.
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Upload any content that is defamatory, obscene, offensive, or infringes the rights of any third party.
- Attempt to reverse-engineer, scrape, or otherwise interfere with the operation of the Service.
- Use the Service to generate composite images for use in impersonation, fraud, or harassment.
We reserve the right to remove any content and suspend or terminate access for any user who violates these rules.
5. Print Orders
Orders placed through the Service are binding once payment has been confirmed. Each print product is personalised to your unique Photofit composite and is therefore produced to order.
Print fulfilment is handled by Prodigi. Estimated dispatch and delivery times are provided as a guide only and are not guaranteed. We are not liable for delays caused by Prodigi, shipping carriers, or circumstances outside our control.
Where you are a consumer based in the United Kingdom, standard statutory cancellation rights under the Consumer Contracts Regulations 2013 apply to non-personalised orders. However, as print orders are manufactured specifically to your design, the right to cancel may not apply once production has begun. Please contact us as soon as possible if you wish to cancel an order.
6. Refunds
If you receive a product that is defective, damaged in transit, or materially different from what was ordered, we will offer a replacement or full refund. Please contact us within 14 days of receipt with photographic evidence of the issue.
Change-of-mind refunds are offered at our discretion. Given the personalised nature of our products, we are unable to guarantee refunds where the product has been produced correctly to your specification.
7. AI-Generated Content
Photofit composites generated by the Service are AI-assisted artistic interpretations of facial features. They are produced in the style of the classic Photofit identification system and are intended as a creative and novelty product only. They are not forensic likenesses, accurate representations, or identification documents, and must not be used as such.
The quality and accuracy of the composite is dependent on the photograph provided and the capabilities of the underlying AI model, which may vary. We do not warrant that the composite will bear a close resemblance to the person depicted.
8. Intellectual Property
The PhotofitMe brand, website design, software, artwork, and all other intellectual property created by Maggetti are owned by or licensed to Maggetti and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.
9. Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, Maggetti shall not be liable for any indirect, incidental, special, or consequential losses arising out of or in connection with your use of the Service, including but not limited to loss of data, loss of revenue, or reputational damage.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
10. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to These Terms
We reserve the right to update these Terms & Conditions at any time. Where changes are material, we will notify registered users by email. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
